Suspension of business single-member limited liability company

* The order of execution

- The person making decision on establishing single-member limited liability company makes the decision on Suspension of business.

A single-member limited liability company may suspend its business but shall notify in writing to the business registration agency of the point of time and period of suspension or resumption of its business no later than 15 days before the date of such business suspension or resumption.

In case the business registration agency or a competent state agency requires suspending a conditional business line, single-member limited liability company must inform the person making decision on establishing single-member limited liability company to make the decision on Suspension of business.

- Directly at the offices of the State administrative agencies.

Written announcement of time and period of suspension or resumption of its business

* Settlement deadline: within 05 working days since receipt of valid application.

- Business registration agency - Department of Planning and Investment.

Announcement is received and information is entered by Business registration agency.

Cases of Suspension of business

- Upon request of the person making decision on establishing single-member limited liability company;

- The business registration agency or a competent state agency may require an enterprise to suspend a conditional business line when it detects that the enterprise fails to satisfy all the conditions prescribed by law.

* The legal basis of the administrative procedure:

Decree No. 172/2013/ND-CP dated in November 13, 2013 of the State on the establishment, reorganization and dissolution of a State-owned single-member limited liability company and subsidiaries of a State-owned single-member limited liability company.
