Notice on update of the information of shareholder as foreign individual, authorized representative of shareholder as foreign organization (for joint stock companies)

a) Implementation order:                                                                                                         

   ·      In case of information or change in full name, nationality, passport number, permanent address, number of shares and type of shares of shareholder as foreign individual; name, Business code, address of head office, number of shares and type of shares and full name, nationality, passport number, permanent address of authorized representative of shareholder as foreign organization, the company sends the Notice on supplement and update of enterprise registration information to the Business registration office where the company registered its head office under provisions in Clause 3 of Article 171 of the Enterprise Law within 03 working days, since the date of information or change.

   ·      Upon receiving the Notice, the Business registration office issues the Receipt, checks the validity of documents and supplements, changes the information of the company in the National database on enterprise registration. Where the company wishes, the Business registration office issues the Certificate on change in enterprise registration information to the company.

b) Implementation method: The company or authorized person implementing procedures of enterprise registration directly submits the Notice on supplement and update of enterprise registration information at the Business registration office where the company registered its head office or via electronic network according to the procedures on the National Information Portal on enterprise registration.

·      Notice on supplement and update of enterprise registration information  (Annex II-5, Circular No. 20/2015/TT-BKHDT);

d) Number of documents: 01 set.

đ) Time limit for settlement: Upon receiving valid documents, the Business registration office supplements, changes the information of the company in the National database on enterprise registration.

e) Implementing agency: Business registration office at provincial level – Department of Planning and Investment.

g) Subjects of administrative procedures: Individuals, organizations.

h) Results of administrative procedures: Information of the company is updated and supplemented in the National database on enterprise registration/ Certificate of change of enterprise registration.

·      Circular No. 20/2015/TT-BKHDT dated 01/12/2015 of the Ministry of Planning and Investment guiding the enterprise registration (Circular No. 20/2015/TT-BKHDT).
